Delivery Malpractice Lawsuit in Mercer County, NJ
This case involves two parents, Jeffrey and Jodi Freeman, who arrived at Capital Health Medical Center in Hopewell, New Jersey for the delivery of their twins in August of 2014. The couple’s first child was delivered; however, the second child did not survive for long after his birth.
The couple alleges that employees at the hospital failed to recognize the second child’s slow heart rate. According to the parents, doctors and nurses on staff did not adequately respond to the infant’s fetal distress and subsequently attempted to deliver the child via vacuum delivery, as opposed to C-section or other maneuvers.
Following the birth, the infant was transferred to the neonatal intensive care unit at The Children’s Hospital of Philadelphia, where he was diagnosed with perinatal asphyxia. Perinatal asphyxia is a medical condition resulting from oxygen deprivation and reduced blood supply to the brain. This condition is often associated with hypoxic or anoxic brain injuries, which are common forms of birth injuries that may result from delayed C-section, failure to perform a C-section, or other delivery errors.
Hypoxic and anoxic brain injuries can spell devastating consequences, including brain damage, Cerebral Palsy, paralysis, other neurological impairments, and even death. In this case, the child was placed on life support for two days before his parents made the difficult decision to remove life support. The baby died just six hours later.
The Freemans are now seeking compensation for their son’s wrongful death, citing medical malpractice and hospital negligence. Of course, nothing will replace their lost child, but they may find some peace in holding those responsible for his death accountable.
