Medical Negligence Allegations in Morris County

On December 15, 2011, 75-year-old Leo Moran Sr. reportedly bludgeoned his wife to death with a baseball bat at their home in Chester Township. Moran, who was brought up on homicide charges, was subsequently acquitted because a Morris County Superior Court Judge determined that he was not mentally fit to stand trial. Moran was ultimately diagnosed with Alzheimer’s Disease and vascular dementia; he is currently living at Greystone Park Psychiatric Hospital.

Just days before Mr. Moran killed his wife, one of his children brought him to St. Clare’s Medical Center for a psychological evaluation. The medical malpractice lawsuit claims that the medical center was negligent because the emergency room staff who conducted his intake, as well as a psychiatrist, determined that Mr. Moran was not suicidal or homicidal. Moran was discharged from the facility after employees decided not to have him committed. The suit also cites Dr. Lawrence Antonucci, a cardiologist who served as Mr. Moran’s doctor for many years, claiming medical malpractice and wrongful death.

According to the plaintiffs, Dr. Antonucci failed to identify that Moran was suffering from dementia. Instead of referring Moran to a psychiatrist or recommending a psychological evaluation, Dr. Antonucci prescribed him anti-anxiety medication and antidepressants. Dr. Antonucci’s attorney said that the doctor did, in fact, recommend a psychological evaluation and that he was prescribing Xanax and Klonopin to treat postoperative anxiety resulting from Moran’s recent hip surgery.

Representatives for both Dr. Antonucci and the medical center claimed that their clients could not have foreseen Mr. Moran’s violent conduct. However, the ultimate power to decide lies with the jury. One thing is for certain: if any of the defendants in this case failed to uphold the medical standard of care, Mrs. Moran’s life was far too high a cost to pay for their negligence.
